I. Ownership of Platform; Agreement to Terms of Use

This document is an electronic record in terms of Information Technology Act, 2000 and rules there under as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures.

This document is published in accordance with the provisions of Rule 3 (1) of the Information Technology (Intermediaries Guidelines) Rules, 2011 that require publishing the rules and regulations, privacy policy and Terms of Use for access or usage of this web platform ("WebPlatform"), including the related mobile Platform and mobile application (hereinafter referred to as "Platform").

The Platform is owned by Rose Industries, a company incorporated under the Companies Act, 1956 with its registered office at __________ and its branch office _____________ (hereinafter referred to as "Rose Industries").

These Terms and Conditions of Use ("Terms of Use") apply to this web Platform, and all associated Platforms linked by Rose Industries, its subsidiaries and affiliates, includingRose Industries Platforms around the world (collectively, the "Platform"). The Platform is the property of Rose Industries and its licensors. By using the Platform, you agree to these Terms of Use; if you do not agree, do not use the Platform.

Rose Industries reserves the right, at its sole discretion, to change, modify, add or remove portions of these Terms of Use, at any time. It is your responsibility to check these Terms of Use periodically for changes. Your continued use of the Platform following the posting of changes will mean that you accept and agree to the changes. As long as you comply with these Terms of Use, Rose Industries grants you a personal, non-exclusive, non-transferable, limited privilege to enter and use the Platform.

II. Content

All text, graphics, user interfaces, visual interfaces, photographs, trademarks, logos, sounds, music, artwork and computer code (collectively, "Content"), including but not limited to the design, structure, selection, coordination, expression, look and feel and arrangement of such Content, contained on the Platform is owned, controlled or licensed by or to Rose Industries, and is protected by trade dress, copyright, patent, trademark and other intellectual property and unfair competition laws.

Except as expressly provided in these Terms of Use, no part of the Platform and no Content may be copied, reproduced, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted or distributed in any way (including mirroring) to any other computer, server, web platform or other medium for publication, distribution or commercial use, withoutRose Industries's express prior written consent.

You may use information on Rose Industries products and services (such as data sheets and knowledge base articles) purposely made available by Rose Industries for downloading from the Platform, provided that you do not remove proprietary notices, use the information only for personal non-commercial informational purpose, make no modifications, and do not make additional representations or warranties related to such documents.

III. Your Use of the Platform

You agree, undertake and confirm that your use of the Platform shall be strictly governed by the following binding principles:

1. You shall not host, display, upload, modify, publish, transmit, update or share information that:

• Belongs to another person and to which you do not have any right.
• Is grossly harmful, harassing, blasphemous, defamatory, obscene, pornographic, paedophilic, libellous, invasive of another's privacy, hateful, racially or ethnically objectionable, disparaging, encouraging money laundering or gambling, unlawful, threatening, or harassing.
• Is misleading, false, inaccurate, or deceptive.
• Is patently offensive, promotes obscenity, paedophilia, racism, bigotry, hatred or physical harm, or advocates harassment.
• Infringes third-party rights including intellectual property, privacy, publicity rights, or trade secrets.
• Contains viruses, malware, trojan horses, worms, time bombs, cancelbots, or other harmful code/programs.
• Harms minors, impersonates another person, threatens public order/security, violates law, or creates liability forRose Industries.
• Includes restricted access pages, hidden pages/images, gambling solicitation, spam, chain letters, or unauthorized sales/advertising.

2. No automated scraping or extraction

You shall not use any deep-link, page-scrape, robot, spider or similar manual/automated process to access, copy, monitor, reproduce or circumvent any portion of the Platform or Content.

3. No unauthorized access

You shall not attempt to gain unauthorized access to any portion or feature of the Platform, systems, networks, servers, or services by hacking, password mining, or any illegitimate means.

4. No probing or security breach attempts

You shall not probe, scan, test vulnerabilities, breach security or authentication measures, reverse look-up, trace users, or exploit Platform information for unauthorized disclosure of personal information.

5. Reputation and infrastructure protection

You shall not make negative, denigrating or defamatory statements about Rose Industries and associated names/domains, nor take actions that tarnish Rose Industries reputation or impose unreasonable load on Platform infrastructure.

6-13. Additional obligations

• Do not interfere with Platform operations or other users, forge headers, manipulate identifiers, or disguise origin of communication.
• Do not use Platform/content for unlawful purposes or rights-infringing activities.
• Comply with applicable Indian and international laws, regulations, taxes, duties, and exchange control provisions.
• You grant Rose Industries a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sublicensable right to use information you provide, in accordance with Terms and Privacy Policy.
• Information supplied by you regarding products/services must be accurate and not exaggerated or misleading.
• No unauthorized advertising or solicitation to other users;Rose Industries may monitor, restrict messaging, remove/edit content, and disclose information as required by law.
• You remain solely responsible for materials/content posted and warrant necessary rights and lawful nature of posted content.

IV. Delivery and Other Terms and Conditions

1. Delivery

• By clicking Place Order, you consent to these Terms and all terms appearing on the Rose Industries Platform.
• Submission of order is subject to acceptance by Rose Industries; order updates are sent by email.
• An order is a non-binding offer; a binding contract forms only after complete payment and successful delivery.
• Delivery dates are estimates. Delays by delivery partners are beyond Rose Industries control and liability.
• If parcel is returned undelivered/refused, Rose Industries may charge full forward and return shipping plus applicable fees; perishable items are excluded from refund claims.
• Cancellation/modification via +91 86906 837095 or roseindustries555@gmail.com is allowed within 8 working hours of order time; after that, cancellation/modification is not allowed.
• Deliveries are during working day (8am to 6pm). Public holiday or local restrictions may shift delivery to next working day.
• If recipient is unavailable, delivery may be made to office reception/front office, or held at nearest Rose Industries branch for customer pickup within 48 hours from scheduled delivery time.
• In such cases, order is considered delivered and Rose Industriesis not responsible for damage/loss thereafter.

• Rose Industries may use provided email/phone details for promotional and marketing communication.

2. Payment

While availing payment methods on the Platform, Rose Industries is not responsible for losses arising directly/indirectly due to lack of authorization, bank limits, payment issues, or transaction decline for any reason.

• All payments for purchases/services on Platform must be in Indian Rupees. Other currencies are not facilitated.
• Rose Industries may request supporting documents (including Government ID and address proof) before shipping/delivery to verify payment instrument ownership.
• Payment facility is a facilitator service and not banking or financial service; Rose Industries is neither trustee nor fiduciary in relation to transactions.
• Card and bank transfer processing is governed by terms between buyer and issuing bank/payment instrument provider.

Disclaimer of Warranties and Liability

This Platform, materials, products (including software) and services are provided on an "as is" and "as available" basis without representations or warranties, express or implied, except as otherwise specified in writing.

• Rose Industries does not warrant constant availability of Platform, or that Platform information is complete, true, accurate or non-misleading.
• Rose Industries is not liable in relation to Platform contents/use and does not warrant Platform, servers, or communications are free of viruses or harmful components.
• Nothing on Platform constitutes advice. Product sale/delivery may be subject to state law constraints; where delivery is not possible, seller may return/credit any advance amount.
• By registering phone number and placing order, you consent to communication via calls, SMS, mobile applications and other electronic modes for order/shipment/delivery updates.
• If any individual provision is invalid, other provisions remain effective; invalid/omitted provisions will be replaced by those closest to parties' intended spirit and purpose.

3. Refund

• Products displayed are subject to availability. In case of supply difficulties/stock unavailability, customer consent will be sought for an alternative product of same value.
• If Rose Industries is unable to supply all or part of an order, customer will be notified and reimbursed for undelivered part in full no later than 30 days after intended delivery date.
• Refund/exchange requests can be made only within 15 days of receiving products. No request is accepted after 15 days.
• Cancellation/modification requests can be made only within 8 working hours of placing order on Rose Industries Platform.

V. Governing Law

These Terms shall be governed, interpreted and construed in accordance with the laws of India, without regard to conflict of law provisions, for resolution of disputes arising out of use of services or in relation to these Terms. Notwithstanding the foregoing, Rose Industries may initiate proceedings before any competent court/forum, and any proceeding brought by you shall be exclusively before courts in Mumbai, India.
